Car accident with moped sends one to hospital

A recent car accident involving an automobile and a moped raises some important issues. The accident occurred at about 3 p.m. on a Monday night in North Carolina, just south of Wilmington on Highway 87 near the intersection of Sunny Point. Few details of the accident were released, except to say the two vehicles collided and one person was sent to the hospital with injuries. Police are continuing to investigate the incident. They did not disclose which driver was sent to the hospital.

According to the North Carolina Department of Motor Vehicles website, mopeds in North Carolina may not be driven over 30 miles per hour and DWI laws apply equally as they do with motor vehicle operators. Mopeds are not required to be registered or inspected regularly or even to carry the same type of vehicle insurance required of cars, trucks and motorcycles. However, a moped driver must still be over the age of 16, though a valid driver’s license is not necessary. Safety helmets are required for all users.

While it remains to be seen what caused the moped accident on the highway, it is clear that operators of motor vehicles must exercise reasonable caution and comply with all motor vehicle laws and regulations pertaining to them. A person injured by the negligence of another, whether or not their vehicle was required to be registered, is entitled to recover monetary damages.
