On Behalf of | Jun 24, 2013 | Truck Accidents |

A man is dead after being struck by an 18-wheeler in the early morning of June 12. North Carolina Highway Patrol reports the man was walking alone when he was struck. The tractor trailer accident is still being investigated by local authorities.

According to reports, the man was a pedestrian walking alone on the side of Interstate 26. Reports are sketchy as to how the accident happened, but dispatchers say they received word of the accident around 6 a.m. First responders found the pedestrian dead at the scene.

Police have not speculated as of this writing about whether any other factors may have contributed to the accident, on the part of the pedestrian or the driver of the vehicle. The truck was moved to another location to be inspected by law enforcement. It is unknown at this time whether the driver is in police custody, but no charges have yet been filed in connection with this incident.

The details of this tractor trailer accident have not yet been fleshed out to the point where culpability can be determined. As further facts are gathered, the deceased victim’s next-of-kin may elect to assess their right to pursue a wrongful death lawsuit against the driver of the truck and/or the company that driver represents. Such a case would be filed separately from any potential criminal charges, and would be handled by a North Carolina civil court. To prevail, it will be necessary to prove that the truck driver negligently caused or contributed to the fatality.
